Omymind Terms of Service

Welcome to Omymind (“Omymind,” the “App,” the “Service,” “we,” “us,” or “our”).

Omymind is an app for meditation, relaxation, focus, sleep, and sound experiences. By downloading, accessing, or using Omymind, you agree to these Terms of Service.

If you do not agree, please stop using Omymind.

1. Service Description

Omymind may provide one or more of the following:

• meditation sessions, breathing exercises, and relaxation content;
• sleep sounds, nature sounds, music, or ambient audio;
• focus timers, reminders, and related tools;
• personalized recommendations, favorites, playback history, or preferences;
• AI-generated or AI-assisted meditation, text, audio, or other content;
• subscriptions, paid content, and other premium features.

Some features may require internet access, an account, device permissions, or payment.

We may adjust features, interface design, content, and service methods as the product evolves.

2. Eligibility

You must have the legal capacity required by the laws of your jurisdiction.

If you are below the minimum age for independently using digital services in your region, you must use Omymind with the consent and supervision of a parent or legal guardian.

A guardian who permits a minor to use Omymind is responsible for supervising that use as required by applicable law.

3. Accounts and Security

Some features may require registration or sign-in.

If you create an account, you agree to:

• provide accurate and valid information;
• protect your account credentials;
• not sell, rent, or maliciously transfer your account;
• take responsibility for ordinary activity conducted through your account.

If you discover unauthorized access or another security issue, please contact us promptly.

We may restrict, suspend, or terminate accounts involved in fraud, attacks, abuse, unlawful activity, or serious violations of these Terms.

4. Acceptable Use

You may not:

• violate applicable laws or public order;
• interfere with, damage, or attack the App, servers, APIs, or networks;
• bypass access controls, payment restrictions, or security mechanisms without authorization;
• maliciously reverse engineer, crack, or commercially exploit the App without permission;
• scrape, copy, redistribute, or resell protected content in bulk;
• impersonate others or use the Service for fraud, harassment, or infringement;
• distribute unlawful, harmful, or rights-infringing content through Omymind;
• use the Service in a way that may harm the platform, other users, or third parties.

We may take reasonable measures against serious violations where permitted by law.

5. Meditation, Health, and Professional Advice Disclaimer

Omymind’s meditation, breathing, sleep, audio, focus, and related content is intended for general relaxation, self-regulation, and lifestyle use.

Omymind does not provide:

• medical diagnosis;
• psychological diagnosis;
• disease treatment or prevention;
• a substitute for doctors, therapists, psychologists, or other qualified professionals.

If you experience serious physical symptoms, persistent sleep problems, psychological crisis, or another condition requiring professional support, seek qualified help promptly.

Use meditation, breathing, and audio content according to your own condition. Stop using a feature if it causes significant discomfort.

6. AI-Generated Content

Some Omymind content may be generated or assisted by artificial intelligence.

You understand that:

• AI output may contain errors, bias, or inaccuracies;
• the same input may produce different results at different times;
• AI content is for general experience and reference only and is not medical, psychological, legal, financial, or other professional advice;
• you are responsible for deciding whether to rely on or use AI-generated content.

Do not rely solely on AI output for important decisions.

7. Subscriptions, Purchases, and Auto-Renewal

Some features may be provided through paid subscriptions, one-time purchases, or other in-app purchases.

If you purchase through Apple App Store, Google Play, or another app store:

• payment is processed by the relevant store;
• price, billing period, and benefits are shown on the purchase page;
• auto-renewing subscriptions renew according to the store’s rules unless you cancel before renewal;
• subscriptions can be managed or canceled in your app-store account settings;
• refund policies are governed by the relevant store.

If a free trial is offered, its duration and conversion to a paid subscription are shown on the purchase page.

We may change future prices or subscription plans where permitted by law. Existing subscriptions remain subject to applicable store rules and purchase terms.

8. Intellectual Property

Omymind and related materials, including:

• software code;
• product names and logos;
• UI and visual design;
• text, courses, images, and animations;
• audio, music, and sound effects;
• AI prompt templates, content structures, and algorithms;
• other protected materials;

are owned by us or the relevant rights holders.

Unless permitted by law or expressly authorized, you may not copy, sell, rent, republish, commercially distribute, modify, or create derivative works from protected materials.

You receive only a personal, limited, non-exclusive, non-transferable, revocable license to use Omymind in accordance with these Terms.

9. User-Provided Content

If you enter text, preferences, feedback, or other content into Omymind, you retain any rights you lawfully hold in the original content.

You authorize us to process such content only as necessary to provide the requested service, including storing, transmitting, generating, transforming, or analyzing it.

You are responsible for ensuring that you have the right to submit the content and that it does not infringe third-party rights.

Unless explicitly stated otherwise, we do not obtain ownership of your submitted content.

10. Third-Party Services

Omymind may rely on or link to third-party services such as:

• app stores and payment services;
• AI model providers;
• cloud services;
• analytics and crash-monitoring providers;
• external websites or content services.

Third parties operate independently under their own terms and privacy policies.

To the extent permitted by law, we are not responsible for the availability, content, rules, or data practices of third-party services.

11. Changes, Suspension, and Termination

You may stop using Omymind at any time.

We may modify, suspend, or discontinue some or all of the Service due to:

• product upgrades or feature changes;
• maintenance or security needs;
• changes to third-party services;
• legal or platform-policy requirements;
• force majeure or circumstances beyond reasonable control;
• serious violations of these Terms.

Purchased benefits will be handled in accordance with applicable law and app-store rules.

12. Disclaimer

To the maximum extent permitted by law, Omymind is provided on an “as is” and “as available” basis.

We make reasonable efforts to maintain stability, but do not guarantee that:

• the Service will always be uninterrupted;
• every feature will be available on every device or in every region;
• all content will be completely accurate, complete, or suitable for every user;
• AI content will always be correct;
• meditation, audio, or sleep content will achieve a specific result.

Experiences with meditation, focus, relaxation, and sleep vary between individuals.

13. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable beyond what the law requires for indirect, incidental, special, or consequential losses arising from:

• use or inability to use Omymind;
• network, device, or third-party service failures;
• your settings, actions, or judgment;
• inaccuracies in AI-generated content;
• data loss not caused by our intentional misconduct or gross negligence.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

14. Privacy

Information processed in connection with your use of Omymind is governed by the Omymind Privacy Policy.

Please read the Privacy Policy together with these Terms.

15. Updates to These Terms

We may update these Terms to reflect product changes, laws, or app-store requirements.

For material changes, we may notify you through the App, release notes, or other reasonable means.

Your continued use after updated Terms become effective means you accept the revised Terms. If you do not agree, stop using the Service.

16. Governing Law and Disputes

These Terms are governed by the applicable laws of the jurisdiction in which the Omymind operating entity is established, subject to mandatory consumer-protection laws that may apply to you.

Disputes should first be addressed through good-faith discussion where possible.

If mandatory law provides different rules for jurisdiction, governing law, or consumer rights, those mandatory rules will prevail.
